End-User License Agreement

1. What this agreement is

This End-User License Agreement ("EULA") is between you and ETHERIX OÜ, Harju maakond, Tallinn, Kesklinna linnaosa, Ahtri tn 12, 15551, Estonia ("we", "us") and licenses the Just Story It software to you: the iOS app distributed through the Apple App Store, the Android app distributed through Google Play, and the web application at app.juststoryit.net. It is concluded between you and us only — not with Apple Inc. ("Apple") or Google LLC ("Google") — and we, not Apple or Google, are solely responsible for the software and its content.

You accept this EULA by downloading, installing, or using the apps, or by using the web application. The service itself — subscriptions, payments, listening minutes, your content and generated stories — is governed by our Terms and Conditions, and data handling by our Privacy Policy. If this EULA conflicts with the Terms on service or commercial matters, the Terms prevail.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Just Story It for personal, non-commercial purposes:

iOS app: on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (except that the app may be accessed by other accounts associated with yours via Family Sharing);
Android app: on Android devices, in accordance with the Google Play Terms of Service;
Web app: through a web browser for your own use.

3. Restrictions

Except as permitted by applicable law or expressly allowed by these terms, you may not: copy, modify, or create derivative works of the software; reverse engineer, decompile, or disassemble it; rent, lease, lend, sell, sublicense, or redistribute it; extract or scrape its content by automated means; circumvent technical limits (including quotas and plan gates); or remove proprietary notices.

4. Updates and requirements

We may provide updates, patches, or new versions, which may be required for continued use, and the apps may require a minimum operating-system version. This EULA applies to updates unless an update comes with its own terms.

5. Intellectual property

The software, its design, and its narrator characters are owned by us or our licensors and are protected by intellectual-property laws. Your own inputs and the stories generated for you are addressed in section 8 of the Terms and Conditions.

6. Maintenance and support

We are solely responsible for maintenance and support of Just Story It; reach us at [email protected]. Apple and Google have no obligation whatsoever to furnish any maintenance or support for the software.

7. Warranty

To the fullest extent permitted by law, the software is provided "as is" and "as available" without warranties of any kind; your statutory rights as a consumer are unaffected. In the event of any failure of the iOS app to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other warranty claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our sole responsibility. For the Android app, Google Play's refund policies apply. For the web app, the remedies in the Terms and Conditions and your statutory rights apply.

8. Product and legal claims

We, not Apple or Google, are responsible for addressing any claims relating to the software or your possession and use of it, including: (i) product liability claims; (ii) claims that the software fails to conform to applicable legal or regulatory requirements; and (iii) claims under consumer protection, privacy, or similar legislation. In the event of a third-party claim that the software or your possession and use of it infringes that third party's intellectual-property rights, we, not Apple or Google, are solely responsible for the investigation, defence, settlement, and discharge of the claim.

9. Legal compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms when using the software (for example, your mobile carrier's data agreement).

10. Third-party beneficiaries

Apple and its subsidiaries are third-party beneficiaries of this EULA with respect to the iOS app, and Google is a third-party beneficiary with respect to the Android app. Upon your acceptance of this EULA, each has the right (and is deemed to have accepted the right) to enforce it against you in that capacity.

11. Termination

This license is effective until terminated. It terminates automatically if you materially breach it; you may terminate it at any time by deleting your account and uninstalling the apps. Sections 3, 5, 7, 8, and 12 survive termination.

12. Governing law

This EULA is governed by the laws of Estonia, excluding its conflict-of-law rules. If you are a consumer, the mandatory consumer protections of the country where you live remain unaffected.
